Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries while working near an air winch system that was not sufficiently anchored to the ground: (a)Dock Area. Employees were exposed to hazards such as but not limited to, crushing injuries, amputations, and sprains while operating and working near an air winch system that was insufficiently anchored with four red dot anchors, four 3/4 inch bolts 2 1/2" in length, and two 25 foot chains. The anchors failed during the pull of a 1,000,000 lb concrete beam, on or about September 18, 2008. Among other methods, one feasible and acceptable abatement method to correct this hazard is to develop procedures to ensure that anchorage point(s) for the air winch system are capable of withstanding loads imposed on them under operating conditions.
