Text For Citation: 02 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees, in that an employee was exposed to struck by hazards: a. On or about June 13, 2006 at 530 North Camp Road, Port Clinton, Ohio: An employee's duties placed him in proximity to the swing radius of the rotating super structure of a Terex- Fuchs Hydraulic Loading Machine, serial number 35011227. The employee was assigned to direct a water spray into rail cars from an elevated platform exposing the employee to the hazards of being struck by the rotating super structure of loading machine and or caught in between the rotating super structure of the loader and the guardrail of the platform. One means of abatement would be: 1. follow the procedures outlined in the Terex-Fuchs operators manual paragraph 2.4, "Danger Zone", " no one is to enter the danger zone of the loading machine." 2. Follow the safe work practices as addressed in the Association of Equipment Manufacturers Operators Safety Manual for Scrap and Material Handlers, which states "Warning: Prevent serious crushing injury. Do not allow others within the safety zone. Death or serious injury can result from contact with moving parts of the handler, attachment or load." In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
