Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or before 6/1/06, at the rear of 54 Liberty Lane, an employee operating a Bob-cat ZT 200 riding lawnmower, Model ZT 200, s/n 94222203629, was exposed to a caught-between hazard when the mower went over an embankment and flipped into the water, due to the lack of rollover protection system installed on the mower. PLEASE NOTE: DOCUMENTATION AND CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION. One feasible and acceptable means of abatement is referenced in the Bob-Cat Operation & Safety Manual, ZT 200 Series. Page 6 references Rollover Protection Structure (ROPS), which is available as an optional accessory. Operators also need to keep the lawnmowers away from the edge of an embankment.
