North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to thrown against, struck by and crushed by hazards while operating the rough terrain forklift: a)new construction site - employee was not wearing the installed seat belt, struck his head against the ROPS and was thrown outside the ROPS protective area while operating the Lull International 844C-42, rough terrain forklift, S/N T2486Q57. Abatement note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to have employees fasten the installed seat belt when operating equipment. References: Lull Operators and Safety Manual: "BEFORE OPERATING THE MACHINE. Check the following: The condition and operation of the seat belt and the mounts. And; ASME B56-6-1992, Paragraph 6.2.1: Before starting to operate the rough terrain forklift truck: (a) be in operating position and fasten seat belt, if so equipped. IN THE ALTERNATIVE: 29 CFR 1926.95(a) Protective equipment, including personal protective equipment for eyes, face, head, and extremities, and protective shields and barriers, were not used whenever it was necessary by reason of hazard encountered in a manner capable of causing injury or impairment in the function of any part of the body through physical contact: a)new construction site - employee was not wearing the installed seat belt, struck his head against the ROPS and was thrown outside the ROPS protective area while operating the Lull International 844C-42, rough terrain forklift, S/N T2486Q57.
