Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about February 13, 2006, at the Six Flags over Georgia Park (Ninja ride) - Employer failed to ensure that the standard guard railing on an Applebee pontoon boat was sufficient, in that, the railing was defective and did not provide stable support for employees on the boat. As a result, an employee drowned. HAZARD(S) MAY BE CORRECTED BY FEASIBLE AND USEFUL ABATEMENT METHOD(S): Utilize safe measures to transport employees to their work site by: (1) Ensure the standard railing on the Applebee Pontoon boat is sufficient, without defect and adequate to protect employees from a fall hazard. (2) Train employees on safe work practices involving traveling over the waterways. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED
