SCRR 71-112A: Failed to furnish a place of employment which is free of recognized hazards which may cause death or serious physical harm to his employees and comply with this regulation and other occupational safety and health rules and regulations promulgated under Chapter 15 of Title 41, Code of Laws, State of South Carolina, 1976, as amended, as follows: A. On or about June 29, 2005, employer knew or should have known that employees engaged in the alteration and repair of the residence septic system were exposed to the hazards associated with entry into confined spaces such as, but not limited to, the pump basin tank. A feasible and useful means of abatement, among others, is to: (1)Develop and implement a written confined space program, including but not limited to, safe work procedures and preplanned rescue procedures; (2)Test, with a calibrated direct-reading instrument, for oxygen content, for flammable gases and vapors, and for potential toxic air contaminants prior to employees entering the confined space; (3)Ensure that no hazardous atmosphere exist within the confined space whenever any employee is inside the space; (4)Provide clean source forced air ventilation prior to any employee entering the confined space and until all employees have left the space; and (5)Provide and utilize rescue equipment and personnel such as, but not limited to, a tripod, safety line, body harness, standby person, proper respiratory personal protective equipment and any other equipment necessary for safe entry into and rescue from confined spaces. OR IN THE ALTERNATIVE SCRR Chapter 71, 1-1910.146(c)(4): Failed to develop and implement a written permit space entry program that complies with this section if the employer decides that its employees will enter permit spaces. The written program shall be available for inspection by employees and their authorized representatives, as follows: A. On or about June 29, 2005, no confined space entry program was developed and implemented for employees engaged in the alteration and repair of the residence septic system pump basin tank to include: (1)Written confined space program; (2)Testing confined space atmosphere for oxygen level, flammability, and known or suspected toxic substances prior to entry; (3)Entry permit; (4)Establish and enforce safe work procedures; and (5)Emergency rescue procedures.
