Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and piercing injuries from moving excavator bucket. a)Site - 2300 NE. 39th Street, Cape Coral, Florida 33909 Caterpillar Excavator - Serial # 2ES00982 - Model # 322BL Excavator operator did not ascertain the location of the employee prior to operating the excavator to move tree trunks, resulting in the employee being struck-by and killed by the excavator's bucket, on or about, 01/17/05. ONE FEASIBLE AND ACCEPTABLE METHOD OF ABATEMENT WOULD BE TO: 1) Follow the Construction Industry Manufacturer's Association Hydraulic Excavator's Safety Manual for Users, Operators and Maintenance Personnel page 17, which specifically states to " Be sure everyone is in the clear before swinging or moving in any direction", and on page 30, which specifically states, "Never travel or swing the machine without first making certain that no one will be endangered"
