Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm in that employees were exposed to a struck by hazard from moving parts on the pump jack. a) Davis & Davis Ranch #B7609; On or about July 2, 2006, the employer did not ensure that employees working near the pump jack were protected from the hazard of being struck-by the moving counter weights. Among other methods, some feasible and acceptable means to abate this hazard include but are not limited to: 1. Ensure that employees are safeguarded from bodily contact with all moving parts by preventing access to the immediate area surrounding the pump jack while in operation. 2. Completely shut down the pump jack prior to working near moving parts. 3. Train employees to recognize the potential hazards associated with moving parts.
