Text For Citation: 01 Item/Group: 003 Hazard: CRUSHING
29CFR Section 5(a)(1) of the Occupational Safety and Health Act of 1970 and the Vermont Statutes: Title 21 VSA Chapter 3, Sub chapter 5, Section 223a of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, the equipment was defective in that the switch circuit failed which showed a problem in the seat safety circuit, and the operator present circuit allowing an operator to move out of the seat and controls were still operative, and the boom was the raised the hydraulic pedals would move and the boom would lower. The safety circuit, normally would render all controls inoperable if operator moved off the seat. "Among other methods, one feasible and acceptable abatement method to correct would be to repair all safety circuits to include the seat belt harness circuit and the operator present circuit." LOCATION: Lawson Farm, Irasburg, Vt. VIOLATION: Employer failed to properly maintain a skid steer to the manufacturers recommendations. Safety switches did not perform in the manner that they were designed and allowed the boom to lower if the employee moved off the seat, exposing employees to crushing hazards when they moved off the seat.
