Text For Citation: 01 Item/Group: 002 Hazard: CRUSHING
29CFR Section 5(a)(1) of the Occupational Safety and Health Act of 1070 and the Vermont Statutes: Title 21 VSA Chapter 3, Sub chapter 5, Section 223a of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, the seat belt safety circuit was bypassed and a toggle switch installed which allowed operation of the skid steer without the seat belt. "Among other methods, one feasible and acceptable method to correct would be to remove the skid steer from operation as it is noncompliant with manufacturers requirement that seat belts be worn while operating." LOCATION: Lawson Farm, Irasburg, Vt. VIOLATION: The employer failed to ensure that the skid steer was operating in a safe manner. The seat belt safety circuit was bypassed, a toggle switch was installed which allowed operation of the skid steer without use of the seat belt which exposed employees to being thrown from the vehicle and subsequently crushed or driven over.n
