Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falling off moving equipment and getting run over: (a)Penn National Race Course, 720 Bow Creek Road, Grantville, Pennsylvania - Between races, employees rode to the next starting line on the starting gate, which was towed by a tractor. The starting gate did not have seats, steps, or any other means designed to accommodate (safely transport) riders. An employee, riding on the starting gate, fell off and was run over by the starting gate, on or about June 8, 2005. Among other methods, one feasible and acceptable abatement method to correct these hazards includes not allowing any person to ride on any piece of equipment not designed or intended for transporting riders.
