Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck or crushed by an excavator: a. On or about April 13, 2006, at the third concrete box base, the employer did not ensure that employees were outside of the tail swing area of the Komatsu hydraulic excavator, exposing an employee to the hazard of being struck by the back end of the excavator and of being crushed between the back end of the excavator and the concrete box. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that the accessible areas within the swing radius of the rear of the excavator is barricaded in such a manner as to prevent an employee from being struck or crushed by the excavator. ABATEMENT CERTIFICATION IS REQUIRED.
