Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling: a.On or about June 9, 2005, at the Mariner's Walk job site, the employer used the Asplundh Model L45 aerial lift in a manner for which it was not intended; that is, as a crane to pull on and lift power poles while an employee was elevated in the bucket. Among other methods, feasible and acceptable abatement methods to correct the hazard is to ensure that the aerial lift is only used for the intended purpose and not as a crane, do not allow employees to be elevated in the aerial lift if there is any additional load on the boom, and provide a crane to assist in the removing and movement of large objects such as poles.
