Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the hazards of being caught in rotating augers and agitators inside the cargo box of a mulch blowing truck: LOCATION: EB-60 TRUCK: ON OR ABOUT NOVEMBER 15, 2005, EMPLOYEES WERE EXPOSED TO THE HAZARDS OF BEING CAUGHT IN ROTATING AUGERS AND AGITATORS INSIDE THE CARGO BOX OF A MULCH BLOWING TRUCK WHEN THEY WORKED IN THE TRUCK'S CARGO BOX TO KEEP ITS CONTENTS FLOWING WHILE THE TRUCK WAS RUNNING AND THE AUGERS AND AGITATORS MOVING. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD WOULD BE TO IMPLEMENT AND ENFORCE A WORK RULE THAT NO EMPLOYEE SHALL ENTER THE TRUCK'S CARGO BOX AT ANY TIME FOR ANY REASON UNTIL AFTER THE POWER TAKE OFF (PTO) ON THE TRUCK IS DISENGAGED, THE TRUCK TURNED OFF, THE IGNITION KEY REMOVED AND HELD (ALONG WITH ALL COPIES OF THE IGNITION KEY AT THE WORKSITE) BY THE INDIVIDUAL WHO IS TO ENTER THE CARGO BOX OF THE TRUCK AND PRIOR TO ENTRY ALL STORED ENERGY IS RELEASED OR BLOCKED.
