Nevada Revised Statute 618.375(1): The employer shall furnish employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees: The employer failed to ensure that a load under the crane operator's direct control was safe, as follows: a.At the storage warehouse, 6875 Speedway Blvd.,#U-104, the crane operator did not stop and refuse to handle an unsafe load. Reference: ANSI/ASME/USAS B30.5 - 1968, Crawler, Locomotive and Truck Cranes, Chapter 5-3 Operation Section 5-3.1.3 (d) Operating Practices. The operator shall be responsible for those operations under his direct control. Whenever there is any doubt as to safety, the operator shall have authority to stop and refuse to handle loads until safety has been assured. One feasible method of abatement would be to assure the crane operator refuses to handle unsafe loads.
