North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that; employees were exposed to the hazard of being struck by and/or crushed by the hopper door of the street sweeper with a damaged and improperly repaired hopper door service latch mechanism and a defective hopper door hydraulic control: a)site, waste water treatment plant - where the 1997 ELGIN Whirlwind, Series L Street Sweeper, S/N L2570S, hopper door service latch had been damaged and repaired in-house not in accordance with the manufacturers recommendations. b)site, waste water treatment plant - where the 1997 ELGIN Whirlwind, Series L Street Sweeper, S/N L2570S, hopper door hydraulic control was defaulting to the close position causing the hopper door service latch to fail. Among other methods, one feasible and acceptable abatement method to correct this hazard is to have trained operators to perform pre-use, during and post-use inspections and qualified maintenance personnel perform scheduled inspections and maintenance as required by the Operators Manual. Reference: The ELGIN Whirlwind Series L Operators Manual, page S-3, Section PRACTICE SAFE MAINTENANCE, states; Keep all parts in good condition and properly installed. Fix damage immediately. Replace worn or broken parts.
