Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: On or about 05/14/04: a)CVS Drug Store, stockroom, 139 Myrtle Ave., Cape May, N.J. - Employee was exposed to a fall hazard of approximately 8'- 1/4" while scanning products. The ladder used to gain access to and egress from the work area did not extend three feet above the working surface. One feasible and acceptable abatement method is to conform to provisions set forth in the requirements of ANSI A14.5-2000, Paragraph 9.3.10. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.0
