Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards associated with unexpected release of pressure from wells: On or about July 16, 2004, employees were exposed to the recognized hazard of unexpected release of well pressure. Among other methods, one feasible method to correct this hazard would be to develop and implement written procedures to identify risks from well pressure and minimize exposure to such risks to levels as low as reasonably practical.
