Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to falling out the back of a moving vehicle: On or about October 5, 2004, on DHLY Court, Ridgefield, CT a rented 16 foot Budget moving truck was used to transport employees. Four personnel were riding in the back of the truck while it was in motion on DHLY Court. The back roll door was open and three employees fell out the back of the truck resulting in one fatality. Among other methods, one feasible and acceptable method to correct this hazard is to ensure personnel are not transported in the back of a vehicle not equipped for passengers.
