Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck, crushed or pinned by shifting or falling granite slabs during the process of unloading an open top intermodal cargo container: A)On or about 12/13/05: At Establishment Following the removal of the top horizontal support bracing of the cargo securement system, an employee sustained fatal injuries when unsupported marble slabs tipped over and pinned him. AMONG OTHER METHODS, FEASIBLE METHODS OF ABATEMENT INCLUDE: 1) Obtain from shipping company, the cargo securement system utilized for transport of goods with a description of load bearing vertical and horizontal members. 2) Develop written procedures for the safe removal of individual crates of natural stone slabs from the interior of intermodal containers which would include but is not limited to: a) Inspection of shipments of natural stone for indications of damage, shifting or any conditions that would indicate that shipment is unstable prior to entry into the container and periodically throughout the unloading process. b) Provide secondary means of support prior to removing any load bearing vertical or horizontal brace from an individual slab or crate of natural stone. c) During the progression of the removal process, ensure that remaining natural stone slabs and crates are secured against tipping or falling. 3) Train employees on the safe removal procedures. WRITTEN ABATEMENT VERIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19.
