Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards while working from an Aerial Lift with two workers operating the controls: (a) Barge 44- Mid-Body Cargo Hold #4: On or about June 15, 2005, two workers working from the platform of a JLG Boom-Supported Elevated Work Platform, Model E300AJP, were simultaneously operating the lift controls. While one worker operated the foot switch, which activates the function controls, and had access to the drive/steer controller, the other worker operated the main lift/swing controller. Since one authorized operator was not in control of the lift at all times, these workers were exposed to crushing hazards. Among other methods, one feasible and acceptable method to correct the hazard is to require one trained and authorized operator to operate all lift controls at all times as recommended in ANSI/SIA A92.5-1992 and the Equipment Manufacturers Institute (EMI) safety manual for aerial platforms.
