Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: employee was exposed to a hazard of contacting moving parts of a wood chipper. a) Work Site: 5/4/05 5 park Road New Windsor, N.Y. : The hazard of death or accidental amputation existed when an untrained employee was operating a wood chipper. A feasible means of abatement is to provide employee with the safety training that is included in the Bandit 250 Wood Chipper Operations Manual and the ANSI Z133.1-2000 for Arboricultural Operations- Pruning, Repairing, Maintaining, and Removing Trees, and Cutting Brush. Employer needs to provid the training to his employee in a language he could understand.
