North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to overhead hazards: a)within the manufacturing facility, melt shop, employees cleaning the pit area were not provided with a means to prevent them from being exposed to overhead hazards, such as but not limited to, falling slag. Among other methods, one feasible and acceptable method to abate this hazard is to clean the pit area with the roof of the furnace on.
