Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that: a. United Railroad Service Inc., on or about 6/23/04 had employees exposed to stuck-by hazards in that, the operator of a Case 580 Super L 2022 backhoe was traveling with the outriggers and back boom not in its traveling position. Equipment Manufactures Institute Safety Manual states, Place the loader bucket and outriggers in the transport position and the backhoe in the transport lock position. At or about the Maple Street railroad crossing in Payne, Ohio. No abatement certification or documentation is required for this item.
