Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that: a. United Railroad Service Inc., on or about 6/23/2004 employees were exposed to struck-by hazards from a Case 580 Super L 2022 backhoe, in that the operator did not follow Equipment Manufacturers Institute Safety Manual. The manual states that the operator must be in control of your machine at all times and assure yourself that the work area is clear of all persons. It is also stated to keep others away from your operation. At or about the Maple Street railroad crossing in Payne, Ohio. No abatement certification or documentation is required for this item.
