Nevada Revised Statute 618.375(1): The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or were likely to cause death or serious physical harm to his employees: The employer failed to ensure that a Smithco Sweepstar 48H sweeper could be safety operated by golf course employees: a.Near the number 6 fairway sand trap, an employee was operating a Smithco Sweeper on a slope, next to the sand trap. The slope he was sweeping at the time of the accident was measured and ranged from 15 to 29 degrees. The Smithco can be operated on a maximum 20 degree slope, according to a decal on the unit. The sweeper overturned, making one complete revolution towards the sand trap, and landed back on its wheels. The operator was found under the sweeper, where it was subsequently determined that he died from mechanical asphyxia due to crushing by heavy weight. The employer had not identified golf course slopes that would exceed the manufacturer's recommendations. The sweeper, at the time of the accident, was not equipped with an angle gauge. Reference the Smithco Decal, indicating a 20 degree maximum slope. One feasible and acceptable method of abatement would be to install an angle gauge.
