Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: being crushed by a manufactured home due to its frame slipping off a hydraulic bottle jack while the home was being manually lifted by hydraulic jack for transport axles and wheels to be re-installed. (a)William T. Barclay property located at 1058 Highway 48 East Extension, 12 miles southeast of Magnolia, Pike County, Mississippi 39652 - On or about October 29, 2004 three employees were exposed to being crushed by a manufactured home slipping off a hydraulic bottle jack due to the employer's failure to provide and ensure the use of "Jacking Plate(s)" and due to the employer's failure to properly train employees according to the manufacturer's set-up/installation training manual, including the use of "Jacking Plate(s)" to prevent the home's frame from disengaging the jack. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide and require the use of "Jacking Plate(s)" in accordance with the mobile home manufacturer's set-up/installation instructions manual while manually lifting a manufactured home, and provide employees with classroom and on-the-job instruction according to the mobile home manufacturer's recommendations for installation and set-up procedures.
