Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not ensure employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm: At the jobsite employees were required to perform work operations from an elevated work platform (man basket) supported by a SkyTrak rough terrain type forklift, Model 8042, Serial #0160005379, without being secured to the forklift as required by the operator's manual and ASME B56.6-1992 standard. The employees were exposed to the kind of hazards associated with falls. Among others, one feasible and acceptable method of abatement would be to incorporate and enforce the proper safety practices for elevating personnel on a work platform, to include but, not limited to the task of securely attaching the platform to the lifting carriage and forks as required by the operator's manual and ASME B56.6-1992 standard, into a working forklift training and certification program as required by OSHA Standard 29 CFR 1910.178(l)(1). ***Pursuant to 29 CFR 1903.19(d), the employer must provide documentation this violation has been abated within 10 calendar days after the abatement date.***t
