Text For Citation: 01 Item/Group: 003 Hazard: FALLING
North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: fall from elevation 1)Employer failed to provide adequate training for H2A farm workers who had been assigned by the employer to paint a 25 foot high roof of a tobacco warehouse. [Reference 29 CFR 1926.503(a)(1)]. Among other methods one feasible and acceptable method of abatement is to conduct an adequate training program in a language which the hispanic H2A farm workers understand. Included in the training should be an opportunity for workers to discuss and ask questions with regard to the training program. OR IN THE ALTERNATIVE: 29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. 1)Employer failed to adequately train H2A farm workers to paint the roof of a 25 foot high tobacco warehouse with Cold- Seal waterproofing paint.
