North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from elevation: 1)Employer failed to provide a working surface free from recognized hazards in that workers were exposed to falls from tobacco warehouse roof which had not been adequately guarded for employees engaged in roofing activities. Employer failed to provide on a low-slope roof, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. [Reference 29CFR 1926.501(b)(10)]. Eleven H2A farm workers hired to perform agricultural activities were working on a warehouse roof and were exposed to fall hazards. Among other methods one feasible and acceptable method of abatement is to install guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. OR IN THE ALTERNATIVE: 29 CFR 1926.501(b)(10): Employees engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system: 1)Employers had assigned H2A farm workers to work on low sloped tobacco warehouse roof without any guardrails, safety nets, personal fall arrest system or any other fall protection.
