North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: being struck by falling limbs or other debris. On October 13, 2003, one employee was struck in the head and fatally injured by a falling slab of wood while working on the ground at the jobsite at 313 Sunset Drive, Greensboro, NC. The exposed employee was working directly beneath where the arborist aloft was making a flush cut without having a clear view of the workers on the ground and without having a two way communications system set up whereby the arborist aloft could communicate with the arborist on the ground. Among other methods, one feasible and acceptable abatement method to correct this hazard is to use commands such as stand clear from aloft followed by a response of all clear from the ground. Prearranged hand signals could be used in lieu of these suggested voice commands. Refer: ANSI - Z133.1-2000 Revision of ANSI Z133.1-1994 - Section 9.2.3 page 73 of the Arborist Safety Checklist.
