***Certification AND Documentation of Abatement Required*** Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards while standing between semi-delivery trucks and the Kelley Kwik-Plate dockboard: On June 4, 2003 and at times thereto the employer failed to: (a)repair or remove from service malfunctioning dockboard located on the "outside" dock; (b)prohibit employee(s) from working at rear of delivery trucks between the truck and face-mounted dockboard; (c)develop and implement a preventative maintenance program; (d)develop and implement a dock safety program. Among feasible and acceptable methods to correct this hazardous condition would be to limit or prevent employee(s) exposure by: 1.Removing malfunctioning dockboards from service until repairs are made. 2.Developing and implementing a routine preventative maintenance proram for Kelley Kwik-plate dockboards as required by the manufacturer. 3.Installing automated powered dockboards. 4.Developing and implementing a dock safety program which includes but not limited to: a.Policy prohibiting employee(s) from working near rear of trucks that are moving, entering or leaving the docking area. b.System for notifying truck drivers when it is safe to enter dock area. c.Policy that trucks are not to be moved until a spotter has verified and communicated to drivers that all employee(s) are clear of the rear of trailer and the surrounding dock area. d.Policy of having employee(s) wear reflective vests when working on/near dock area. e.Train all affected employee(s) on established procedures and recognition of hazards. f.Establish and enforce a disciplinary program for employee infractions.
