Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck or burned by exploding pyrotechnics: a)4th Street Behind P&C Stadium, On or about 6/14/03: Employees were exposed to the hazard of explosion and fire when lighting a pyrotechnic display. Among other methods, feasible and acceptable abatement methods to correct these hazards are to: 1)Follow all of the requirements of NFPA 1123, 2000 edition, Code for Fireworks Display. Including, but not limited to: a)Non metal mortars shall be used for single break aerial salute shells. (2.1.7.1) b)Wherever more than three shells are chain fused together, additional measures shall be required to prevent adjacent mortars from being repositioned in the event that a shell explodes in a mortar, causing it to burst. (2.6.1) c)For mortars in racks, prevention of repositioning shall be accomplished by using mortar racks that have sufficient strength to withstand failures. (2.6.1.2) d)All chain fused aerial firework devices shall be positioned securely to prevent tipover or hazardous movement during operation. (2.6.1.5) e)All employees shall be fully trained in the proper performance of their assigned tasks and the employees shall be educated with regard to safety hazards. (5.1.3.2) f)Measures shall be taken to protect all pyrotechnic materials from adverse weather conditions. Moisture-damaged materials shall not be used. (5.1.7) g)Manually fired shells shall be ignited by lighting the tip of the fuse. As soon as the fuse is ignited the shooter shall vacate the mortar area. (5.2.6) h)Manual reignition of chain-fused aerial shells shall be attempted only at properly installed ignition points. (5.2.11) i)Mortars shall be inspected before the first shells are loaded to ensure that no water or debris has accumulated in the bottom of the mortar.
