Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards: On or about October 2, 2003, at the jobsite, an employee was preparing to inspect the engine compartment of the John Deere scraper to locate an oil leak. The engine compartment hood was raised, the employee was on the top step of the engine compartment. The operator did not ensure everything was clear before putting the scraper in motion. An employee was exposed to crushing injuries from the moving equipment. Among other methods, one feasible and acceptable method to correct this hazard is: Prevent employee(s) from being near the earth moving equipment while the operator is in the seat with engine running, as referenced in the John Deere operator's manual Safety Rules, page 1. Walk completely around the scraper making sure everyone and everything is clear before starting to work. Do not allow anyone near the scraper while the driver is in the seat with the engine running. 29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is complete.
