North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Struck by hazards from the falling hoist, mounting rail, chains, tires and other components of the hoist system in the event of a failure. a)facility, re-capping areas - metal trolley rail for the underhung electric, 1 ton chain hoist, was not securely fastened to the building supports. Among other methods, one feasible and acceptable method to correct this hazard is to design the supporting structure, including the trolleys, monorail, and other connectors to withstand the forces and loads imposed by the hoist. Reference: ANSI B30.16, section, 16-1-3, paragraph 16-1.3.2. b)facility, re-capping area - metal lifting device used for lifting large truck tires, was not marked with the load rating. Among other methods, one feasible and acceptable method to correct this hazard is to visibly mark all below the hook devices with manufacturers load rating. Reference: ANSI B30.20, Section 20-1.2.1, paragraph a and b. c)facility, re-capping area - periodic and documented inspections of all hoist systems to include the connecting frame, trolleys, hoist with components, and below the hook lifting devices were not conducted by a designated person. Among other methods, one feasible and acceptable method to correct this hazard is to provide for inspections of the hoist systems and all of its components.
