Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about 26 Dec 2002 two employees were working in a man basket being elevated by a forklift. The employees were replacing a 4 inch (101.6mm) vent pipe. The work area was at an elevation of approximately 15 feet (4.572m). The employees were exposed to a fall hazard due to the lack of a self locking access bar / door on the basket. The basket did not have a load rating and did not have a toe board for the door area. The forklift and basket was not in compliance with ANSI B56.1-1969 in that they were not inspected prior to use. b) The employees operating the man basket were exposed to a fall hazard due to the lack of training provided by the employer in operating this particular man basket. Among other methods, one feasible and acceptable abatement method to correct the hazards would be to obtain a man basket that is approved by the manufacturer of the forklift and use the basket with that specific forklift. Ensure that the basket has self latching access bar/ door that opens inward only. Ensure that the basket and forklift meet the requirements of ANSI B56.1-1969.s
