Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck/crushed by hazard: The vehicle operator(s) was exposed to the hazards created by the faulty equipment,parts and accessories on the sidekick/dump type truck. a.Employer did not have a vehicle inspection/maintenance program. b.Vehicle needed three (3) defective tires to be replaced. c.Gears inside cab did not engage the PTO. d.Exposed rotating PTO shaft was not guarded. e.Safety signs/labels were not located on truck. This occurred on 02/25/03 at 304 Lope De Vega,Laredo,Texas. Among other methods for abatement,one feasible and acceptable abatement to correct this hazard would be to keep in safe and proper operating condition at all times all parts and accessories,as specified in CFR49 Part 396 Section 396.3 Inspection,repair and maintenance,Texas Driver Handbook page 2-1,Texas Commercial Motor Driver Handbook page 2-1 along with the vehicle operators manual. Assistance information on the Medium Duty Truck & Chassis Warranty & Owners assistance information booklet page 4, Maintenance section page 134 and the Caterpillar Operation & Maintenance Manual page 3-11. Essential elements of this procedure would include: 1.Implement a vehicle inspection/maintenance program. 2.Replace the three (3) defective tires. 3.Repair or remove the PTO. 4.Guard the rotating PTO shaft. 5.Place the PTO safety signs/labels on recommended locations.
