Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of getting struck by tank manway hatch. a)On or about 10/29/02, a tanker company employee was struck by the rear manway hatch when it failed. Among other methods, feasible and acceptable abatement methods which the employer could pursue are: 1)Develop a procedure for tank repairs when the manway hatch leaks. 2)Establish, implement and document an inspection and testing program to detect any tank failures or abnormalities prior to daily tanker start-up. 3)Insure that employees are clear of the hatch when pressurizing the tank after any repair or modification.
