Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to the hazard of being struck-by falling fuel (shredded bark) and engulfed while manually moving the fuel from a large pile in to a floor conveyor. (a)On or about January 21, 2002, an employee working alone in the Fuel House was exposed to being struck and engulfed by falling fuel (shredded bark). While moving fuel with a pitch fork into the floor conveyor, the employee was knocked down and covered by fuel that had broken loose from the top of the 18 foot fuel pile accumulated along the back wall of the Fuel House. Among others, one feasible and acceptable method to correct this hazard is to develop written operating/safety procedures for working in the Fuel House that include: 1) Regularly knocking down the top of the fuel from the back and side walls and 2) keeping the fuel further back from both sides of the floor conveyor so there is at least 8 to 10 feet clearance down the center of the Fuel House.
