North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard. a)job site - employer failed to establish, implement, and maintain a preventative maintenance program for the half/pack loader to monitor the condition of hydraulic lines, to include age, damage, wear, flexibility, outer covering protection/condition and prevent employee(s) exposure to injuries, illness, or death as a result of repeated catastrophic half/pack hydraulic hose assembly failures. One feasible and acceptable abatement method, among others, to correct this hazard is to ensure that a more frequent and thorough inspections, maintenance, and verifiable quality controls of hydraulic hose assemblies are implemented according to the manufacture's specifications in an effort to reduce repeated failures and initiate a pre-failure replacement program.
