Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY THE EQUIPMENT : a)Tool Shed, 321 East Whitesboro Street, Rome,N.Y., on or about 3/19/02: (3) three ton capacity Ratliff manually lever operated chain hoists used by lineman/field technicians to tension suspension strand or cable had throat latches missing from the load and support hooks. b)Wash Room, Truck Maintenance Garage, 321 East Whitesboro Street, Rome, N.Y., on or about 3/19/02: (1)one and one half ton capacity Ratliff manually lever operated chain hoist used by lineman/field technicians to tension suspension strand or cable had throat latches missing from the load and support hooks. ABATEMENT NOTE: One feasible means of abatement is to ensure that throat latches on hooks of manually lever operated chain hoists are maintained per American National Standard ASME HST-3M-1991, Section 3.4(b).
