Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: ***Certification AND Documentation of Abatement Required*** being thrown from/crushed by a vehicle that has a roll-over protection structure (ROPS) and a operator restraining device (seat belt) provided. On or about March 17, 2003 at the Forrest Park Lawndale Cemetery, an employee was hauling a load of dirt from a grave site in a Mini-Haul Series IV Diesel/Vault Carrier, Serial number 44, without the use of the operator restraining device provided. Among other methods, one feasible and acceptable method to remove this hazard is: (a)ensure that equipment operators are trained on the use of and ensure the use of seatbelts that meet the requirements of the Society of Automotive Engineers, J386-1969, Seat Belts for Construction Equipment.on
