Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries while working between a trailer and the dock wall: a) On or about 10/15/01, the employee was allowed to be positioned between a parked trailer and a fixed surface while the employee was placing a seal on the trailer container. The employee was exposed to crushing injuries from the trailer rolling backwards, pinning the employee between the trailer and the wall. Among others, feasible and acceptable method of abatement would be to implement and enforce a strict policy that trailers are not to be hooked up or moved until the driver and a spotter have verified that the area is clear and safe and that all trailers are sealed while parked in the bay.
