Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: At the jobsite of Stephens Martin Paving, L.P. located at 3 miles south of U.S. Highway 83 on FM 89, Abilene, Texas 79606 an employee was authorized to operate a Lay-Mor, SweepMaster 8C, serial number 27769011. The employee was not wearing the seatbelt provided on the vehicle and was ejected from the machine when attempting a U-turn, causing the sweeper to rollover on the right side, causing fatal injuries to the employee. Among others, one feasible and acceptable method of abatement would be to establish a 5 element training program for equipment operators. A) Select only responsible persons to operate the equipment. B) Train operators, both lecture and hands-on type training, on job task operating instructions, operator's manual, warnings, precautions, and the safe practices for the operations of the type of equipment being used. C) Evaluate and certify operators on job task operating instructions, operator's manual, warnings, precautions, and the safe practices for the operations of the type of equipment being used. D) Monitor operators for compliance with job task operating instructions, operator's manual, warnings, precautions, and the safe practices for the operations of the type of equipment being used. E) Provide refresher training for operators on job task operating instructions, operator's manual, warnings, precautions, and safe practices for the operations of the equipment being used.
