Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. Employees were exposed to equipment tipover hazards associated with self-propelled aerial work platform (scissorlift) operations where an employee was working from a mobile aerial work platform that had been extended to 20 feet during windy conditions. Location: Hamden, CT, Walgreens construction site, corner of Dixwell Avenue and Putnum Avenue On or about April 27, 2001 An employee was working from a self-propelled aerial work platform (model #SL-20, serial #9427400894) with two 4'x 8' sheets of sheets of material and strips of plywood on the platform. The platform was extended to its maximum extension of 20 feet and in use during windy conditions. The Operation Manual provided with the platform stated, "! WARNING DO NOT operate the WILDCAT SL-20 series scissorlift in windy or gusty conditions". Among other methods, one feasible and acceptable abatement method to correct the hazard would be to provide and use machinery within the manufactures specifications.
