Text For Citation: 01 Item/Group: 001A Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Employees operating powered industrial trucks ( clamp trucks ) including, but not limited to, the Nissan 905L clamp truck were exposed to the hazard of being thrown from the truck and struck by the truck or overhead guard in the event of truck tipover, or being knocked out of the truck and struck by falling paper rolls, in that employees were not required to wear the seat belts provided in the powered industrial trucks ( clamp trucks ). Among other methods, one feasible and acceptable method to correct this hazard would be, in accordance with ASME B56.1 The American National Standard for Powered and Nonpowered Industrial Trucks, to require the use of the seat belt system that was installed in the truck.
