North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that a hoist was installed in such a manner as to require an employee to work/pass under the suspended load, (Para 16-1.3.3, ASME B30.16- 1993): a)Schuler Press-employees were required to pass beneath a steel door being supported by a Budgit hoist, to enter the interior of a Schuler F2-1600, 0-800 Multi-Station Press, to change die sets. "ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG OTHERS, TO CORRECT THIS HAZARD IS TO CONTRACT WITH THE ORIGINAL MANUFACTURER TO RETURN THE MACHINE TO IT'S ORIGINAL CONDITION."
