North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that Adjustments, repairs, and replacements had not been done to a hoist, (Para 16-2.3.3, ASME B30.16-1993): a)Schuler Press-damaged and worn heavy service hooks and load suspension components to a 1/4 ton Budgit had not been replaced, nor was there a data plate or warning label mounted on the frame of the hoist,IAW para 16- 2.3.3(d)(2), (5), and (8), ASME B30.16-1993; para 10- 1.2.1.2, 10-1.2.3 ASME B30.10-1993. "ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG OTHERS, TO CORRECT THIS HAZARD IS TO CONTRACT WITH THE ORIGINAL MANUFACTURER TO RETURN THE MACHINE TO IT'S ORIGINAL CONDITION."
