North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to an over loaded hoist, (Para 16-3.2.1, ASME B30.16-1993; para 10-1.2.1.2(c)(3) & (4), ASME B30.10-1993): a)Schuler Press-a shank hook in heavy service, used to mount a 1/4 ton Budgit pneumatic hoist to an attachment point, failed causing a 770 lb steel door of a Schuler F2-1600, 0-800 Multi Stage Press to fall and strike an employee on 01/08/00. "ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG OTHERS, TO CORRECT THE HAZARD IS TO CONTRACT WITH THE MANUFACTURER TO RETURN THE MACHINE TO IT'S ORIGINAL CONDITION.
