Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by vehicles: (a) Location - In the Scrap Yard: On or about 2/28/02, employees were exposed to being struck by trucks carrying scrap metals backing up to various locations within the yard to deliver scrap. Among other means, one feasible means of abatement would be to institute a traffic management program where trained employees are used to direct traffic backing into off- loading areas.g
